FPSC International Srls offers this website, including all information, tools, and Services available from this site to you, the user, conditioned upon your acceptance of all terms, conditions, policies, and notices stated here.

By visiting our site and/or purchasing something from us, you engage in our "Service" and agree to be bound by the following terms and conditions ("Terms of Service", "Terms"), including those additional terms and conditions and policies referenced herein and/or available by hyperlink. These Terms of Service apply to all users of the site, including without limitation users who are browsers, vendors, customers, merchants, and/or contributors of content.

Our store is hosted on Shopify Inc., which provides us with the online e-commerce platform that allows us to sell our products and Services to you.

Section 1 - General Conditions & Online Store Terms

By agreeing to these Terms of Service, you represent that you are at least the age of majority in your state, province, or country of residence.

You may not use our products for any illegal or unauthorized purpose nor may you, in the use of the Service, violate any laws in your jurisdiction (including but not limited to copyright and intellectual property laws). You must not transmit any worms, viruses, or any code of a destructive nature.

We reserve the right to refuse service to anyone for legitimate reasons at any time. You understand that your content (not including credit card information) may be transferred unencrypted over various networks. Credit card and payment information is always encrypted during transfer over networks.

Section 2 - Accuracy, Completeness, and Timeliness of Information

We strive to ensure that all information on this Site is accurate, complete, and current. However, occasionally product descriptions, pricing, promotions, shipping charges, transit times, or availability may contain typographical errors or inaccuracies.

We reserve the right to correct any errors, inaccuracies, or omissions, and to change or update information or cancel orders if any information on the Site is inaccurate at any time without prior notice (including after you have submitted your order). In the event of an order cancellation due to a pricing or stock error, any payment processed will be promptly refunded in full. 

Section 3 - Contract Formation, Products, and Pricing

  • Prices: All prices listed on the Site are expressed in Euros (€) unless otherwise specified. For deliveries within the European Union, prices include applicable VAT. Shipping fees and custom duties (where applicable) are detailed during checkout. Prices for our products are subject to change without notice prior to contract completion.

  • Order Acceptance: The presentation of products on the Site constitutes an invitation to offer. Upon placing an order, you will receive an automated order confirmation email. This email does not constitute acceptance of your order; the sales contract is concluded only when we dispatch the product and send you a shipping confirmation email.

  • Product Descriptions & Handcrafted Nature: We make every effort to display as accurately as possible the colors, materials, and features of our jewelry. Because cameo crafting and fine jewelry involve artisanal elements, slight natural variations may occur.

Section 4 - Shipping, Returns, and Right of Withdrawal

All purchases made through the Site are subject to our Shipping Policy and Refund & Return Policy, which form an integral part of these Terms of Service.

  • Consumers residing in the EU/EEA have a statutory right to withdraw from the contract within 14 days of receipt of the goods without giving any reason, subject to exceptions outlined in our Refund Policy (e.g., custom-made, resized, or engraved items, and unsealed earrings for hygiene reasons).

Section 5 - Legal Guarantee of Conformity (EU Consumers)

If you are a consumer residing in the European Union, products purchased from Cameo & Beyond are covered by the Legal Guarantee of Conformity pursuant to the Italian Consumer Code (Legislative Decree 206/2005) and EU Directive 2019/771.

  • We are liable for any lack of conformity that becomes apparent within two (2) years from delivery of the product.

  • In case of a defect, you are entitled to have the product brought into conformity free of charge (by repair or replacement) or, if repair/replacement is impossible or disproportionate, to an appropriate price reduction or cancellation of the contract with a full refund.

  • You must notify us of any defect within a reasonable timeframe by contacting info@cameoandbeyond.com.

Section 6 - Accuracy of Billing and Account Information

We reserve the right to refuse or limit any order placed with us (e.g., in cases of suspected fraudulent activity or commercial resale). You agree to provide current, complete, and accurate purchase, billing, and account information for all purchases made at our store.

Section 7 - Intellectual Property Rights

All content included on or available through the Site—including text, graphics, logos, images, digital downloads, designs, jewelry patterns, and software—is the exclusive property of FPSC International Srls or its content suppliers and is protected by Italian and international copyright, trademark, and intellectual property laws.

You agree not to reproduce, duplicate, copy, sell, or exploit any portion of the Site or products without express written permission from us.

Section 8 - Third-Party Links & Optional Tools

Certain content, products, and services available via our Service may include materials or links from third parties (such as payment gateways, logistics partners, and Shopify integrations). We are not responsible for examining or evaluating the content or accuracy of third-party websites and assume no liability for third-party materials or practices.

Section 9 - Limitation of Liability

Nothing in these Terms of Service shall limit or exclude our liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, or any liability that cannot be excluded or limited under applicable mandatory consumer laws.

To the maximum extent permitted by applicable law, FPSC International Srls shall not be liable for any indirect, incidental, punitive, or consequential losses or damages arising out of your use of the Service or products, where such losses were not reasonably foreseeable to both parties at the time the contract was formed.

Section 10 - Severability & Termination

If any provision of these Terms of Service is determined to be unlawful, void, or unenforceable, such provision shall nonetheless be enforceable to the fullest extent permitted by applicable law, and the unenforceable portion shall be deemed severed from these Terms. Such determination shall not affect the validity and enforceability of any remaining provisions.

Section 11 - Governing Law and Jurisdiction

These Terms of Service and any separate agreements whereby we provide you Services shall be governed by and construed in accordance with the laws of Italy.

  • Consumer Disputes: If you are a consumer, any mandatory statutory consumer rights of your country of residence will continue to apply. Disputes shall be submitted to the exclusive jurisdiction of the courts of your place of residence or domicile.

  • Online Dispute Resolution (ODR): European consumers may also access the European Commission's Online Dispute Resolution platform for out-of-court resolution of online disputes at: https://ec.europa.eu/consumers/odr.
